Assisted Living Facilities Abuse and Neglect

An assisted living facility (ALF) is designed to provide care for seniors who do not need a nursing home but prefer a residence that is a home-like environment where some of their needs are met.

Facilities can range from luxury apartments and small homes to modest rooms that are shared with another resident. The facilities can range from one person to several hundred residents. Some facilities allow the elder to "age in place" so the individual can stay in the same residence as their healthcare needs change.

As an alternative to a nursing home, an ALF offers the option of meals, group and organized activities, and transportation to events and appointments. For those who need a little more help, medications are given, health care services are arranged, and health is monitored.

Assisted living facilities are licensed by the state of Florida. The state Agency for Health Care Administration Web site maintains a Web site which lists the facilities around Florida to help you in your search for a good facility.

A search of deficiencies in nursing homes and assisted living facilities can be found on the same Web site.

While ALFs promise high-quality care, because they do not provide the same degree of monitoring of the residents, assisted living facilities abuse and neglect can sometimes occur.

The abuse might come in the form of overmedicating the elder, or can be as blatant and violent as hitting, kicking, or sexual and financial abuse. Staff could fail to monitor the ALF residents, subject them to falls, burns, or failure to treat illness.

While the majority of ALFs are staffed by caring people, there are exceptions. It is important for a loved one to make sure the ALF is licensed with the state and has adequate staff that has undergone background checks. It is also important to act immediately if you suspect there has been abuse at a loved one's ALF. Not only do you deserve compensation, but by filing a lawsuit, you may be able to prevent future abuse of yourself or others in the facility.
