Farah & Farah Wins Million Dollar Verdict for Jacksonville Woman Injured in Rear-End Auto Accident

Jacksonville, Florida - February 17, 2011

The Jacksonville law firm of Farah & Farah secured a one million dollar verdict in Duval County Circuit Court, February 16, for a Jacksonville woman who was seriously injured in a rear-end collision on Interstate-295 two years ago.

Angela Scarberry, 30, was driving her Toyota Camry on I-295 on November 13, 2008, when her vehicle was rear-ended by a Honda Accord being driven by Richard Vanderhoof.  Vanderhoof’s car submarined under the Camry and was also significantly damaged. Scarberry’s husband took his wife to St. Vincent’s HealthCare in Jacksonville for immediate treatment following the rear-end collision.

Attorneys Eric S. Block, and Randall Rutledge, established Vanderhoof was negligent and traveling at least 30 miles per hour at the time of the collision.

Scarberry, the mother of two children, suffered serious injuries to her neck and lower back, which she continues to receive treatment for today.

“The injuries greatly challenge her ability to be active with her family and have significantly limited her ability to perform everyday activities,” said Randall Rutledge.

Two years after the collision, Scarberry continues to receive pain management injections regularly to her neck and back. Mrs. Scarberry’s treating pain management doctor opined at trial that she will need extensive pain treatments in the future, including radio frequency lesioning (RFL) and continued injections in the neck and back. 

State Farm, the auto insurer for Mr. Vanderhoof, had offered $35,000 before trial. A proposal for settlement was served on the defendant July 2010 for $100,000, which was rejected, therefore, Mrs. Scarberry’s attorneys plan to seek attorney fees and costs associated with going to trial accrued since that time, which are predicted to be significant.

The trial, 16-2009-CA-019780 Scarberry v. Vanderhoof, began Monday, February 14, and was heard before a six-member jury. The jurors deliberated three hours before delivering the $1,019,871.06 verdict.    

The award included $638,000 for future medical expenses and $300,000 for future pain and suffering. Jurors included $50,000 for past pain and suffering as well as $30,950 for past medical bills.
