Company must pay for barge accident
By PAUL PINKHAM
The Times-Union
A Jacksonville construction company was ordered Monday to pay $19.2 million to eight people injured when the boat they were on slammed into a dimly lit barge in the Cedar River three years ago.
U.S. District Judge Harvey E. Schlesinger said Superior Construction Co. was entirely to blame for the collision for inadequately lighting the 128-foot "black invisible" barge and improperly placing it and a tugboat in the channel beneath the Blanding Boulevard bridge. He said the company never notified the U.S. Coast Guard, which could have warned boaters it was there.

2009 CASES AND AWARDS
Mr. Rutledge represented the family of a Jacksonville truck driver that was struck and killed by another tractor-trailer as he was entering an out-of-state loading facility. The truck driver was survived by a minor son who resided in Jacksonville with his mother. A lawsuit was filed against the driver of the adverse tractor-trailer driver and trucking company resulting in settlement of $1,350,000.
As a driver of a flatbed truck proceeded home after a long day of work, unbeknownst to him, a large, inadequately lighted trailer was stopped across the road in front of him. Unfortunately, a large collision took place killing the driver of the flatbed truck. After being retained by the driver's wife, Mr. Rutledge obtained a confidential recovery in the case that now provides for the surviving wife who is unable to work.
A husband and his wife of 43 years, while on vacation in Tampa, were traveling through a major intersection when their vehicle was struck by another driver. There was catastrophic damage to both vehicles. Through the investigation, Mr. Rutledge discovered that the other driver had been drinking beer shortly before the crash. With Mr. Rutledge's efforts, the other driver's insurance carrier paid its policy limits for both the husband and his wife who had passed, along with a full recovery against his own underinsured motorist coverage
A tragic crash of a company van into the rear of a tanker truck left a young Interlachen woman a widow as her husband of three years died in the crash. Three of her husband's co-workers sustained very significant injuries in the crash also. On behalf of wife and the Estate, Mr. Rutledge filed a lawsuit against the driver of company van and her husband's employer. After a long legal battle during which the employer's insurance carrier took the position its significant insurance policy did not apply in the case, a substantial, favorable settlement was reached that has helped this young widow provide for her and her family.
A very young and active 69-year-old courier for a local law firm was on his way home when his vehicle was struck by a young, inexperienced driver. This collision resulted in significant medical treatment and bills for him. The insurance carrier for the at-fault driver refused to pay its policy limits. After filing the lawsuit and going through the litigation process, the client's underinsured motorist carrier paid its $250,000 policy limits. Mr. Rutledge continued his prosecution of the case against the at-fault driver and eventually made a recovery of five times the policy limits against the at-fault driver.
More than two years after being rear-ended by a landscaping truck, a 51-year-old engineer hired Farah & Farah to represent him for serious injuries sustained in the crash. At any point during that time period before Farah & Farah was hired, the at-fault insurance carrier could have done the right thing and paid its policy limits to the injured engineer, but they refused. After coming to Farah & Farah, Mr. Rutledge filed a lawsuit against the at-fault driver and the landscaping company. Through litigation, Mr. Rutledge obtained $625,000 for the engineer.
A spry, vivacious 74-year-old woman was volunteering at a local festival when she was injured in a severe fall while dancing on a temporary dance floor. The fall resulted in a serious fracture and surgery. Mr. Rutledge obtained video of the accident that clearly established fault on the part of the defendants and eliminated liability issues from any discussion of the case. A lawsuit was filed against multiple parties, and with the evidence obtained by Mr. Rutledge during his investigation and prosecution of this matter, a confidential recovery was obtained.

David Hartsock has worked as an attorney for the insurance industry, supervising claims and overseeing litigation. Now with Farah and Farah as a Case Manager, Hartsock is on the other side of the fence. His background allows him to understand the ins and outs of the insurance industry, with a working knowledge of procedures and the value of a case. He graduated with a Bachelors of Arts degree from Ashland College in Central Ohio in 1977, and earned a J.D. degree from the University of Akron in 1981.

Sullivan understands what the insurance industry requires to settle your claim. In her spare time, Sullivan likes the fast pace of regattas and competitive racing large sailboats on the St. John's River.
